На Одещині замовили укриття за 97 мільйонів від Ukraine Facility по дуже завищених цінах

Управління освіти, культури, молоді та спорту Вигодянської сільської ради (Одеська обл) 10 червня за результатами тендеру замовило ТОВ «Давмір Строй» будівництво укриття за 97,41 млн грн. Про це повідомляється в системі «Прозорро».

В день підписання договору строки виконання робіт продовжили з кінця 2025 року на березень 2026 року.

У селі Вигода на вулиці Шкільна, 23 повинні побудувати підземне укриття для двох навчальних закладів: дитсадка «Вишенька» та «Вигодянського ліцею». Укриття площею 2 010 кв. м розраховане на 711 осіб: учнів, вихованців і персонал обох закладів.

Згідно з договірною ціною, вартість будівельних робіт без врахування устаткування, меблів і інвентарю становить 86,77 млн грн з ПДВ. Це означає, що кожен квадратний метр укриття коштує 43 169 грн (910 євро), що на 45% дорожче встановленої Мінрозвитку вартості спорудження житла в Одеській області, яка складає 23 648 грн/кв. м.

Проект замовили ТОВ «Таурі Інжиніринг». Позитивний експертний звіт з питань кошторисної частини проектної документації видало ТОВ «Експертна компанія «Основа».

Договірна ціна тверда та включає 355 тис. грн на додаткові витрати через інфляцію. Роботи фінансуватимуться Європейським Союзом через програму Ukraine Facility.

Середньомісячна заробітна плата одного робітника в режимі повної зайнятості та розряді робіт 3,8 становить 18 570 грн. За даними Пенсійного фонду, показник середньої зарплати для обчислення пенсії – 19 856 грн, середня зарплата за вакансіями у будівельній галузі на порталі «Work.ua» у Одесі складає 25 000 грн.

Ціни в кошторисі завищені у півтора рази

У інформації про ціни на матеріальні ресурси бетон С20/25 W6 F150 врахували по 4 740 грн/куб. м (тут і далі ціни вказані з ПДВ та без доставки). Одеська компанія «Хай-Рейз Констракшнз Холдинг» продає такий бетон по 3 350 грн/куб. м, що на 29% дешевше, а компанія «Вестт» – по 3 650 грн/куб. м, що на 23% дешевше.

Доставка бетону коштує 2 051 грн/куб. м. Відстань між Одесою та Вигодою 42 км. «Хай-Рейз Констракшнз Холдинг» пропонує послуги з доставки бетону на 41-45 км по 360 грн/куб. м, що більше ніж вп’ятеро дешевше.

Полімерно-епоксидну наливну підлогу Teкnobond 500 врахували по 1 073 грн/кг. Компанії «Teknosel» та «Арфен Україна» продаю її по однаковій ціні 689 грн/кг, що на 36% дешевше.

Арматуру класу А500С діаметром 12-14 мм замовили по 59 166- 59 477 грн/т. Компанія «IronWorld» продає її по однаковій ціні 34 160 грн/т, що на 42% дешевше, а «Булат-Метал» пропонує її по 33 800 грн/т, що на 43% дешевше.

Невідому мембрану ПВХ товщиною 1,5 мм замовили по 594 грн/кв. м. Інтернет-магазин «Техно» продає ПВХ мембрану Tetto Rooftop ST 1.5 мм по 367 грн/кв. м, а продавець «Sweetondale» на майданчику «Епіцентра» пропонує ПВХ мембрану Danopol HS 1,5 мм по 368 грн/кв. м. Це на 38% дешевше.

Невідому суху модифіковану цементну суміш для шпаклювання мінеральних основ замовили по 31 грн/кг. «Строймат Київ» продає будівельну суху модифіковану суміш «Master-Strong» по 6 грн/кг, а «Епіцентр» по 7 грн/кг, що більше ніж вчетверо дешевше.

Орієнтовна сума переплати лише по цим позиціям може скласти понад 6 млн грн.

Фірма отримала підряд без конкуренції, бо на відкриті торги більше ніхто не подався.

Управління освіти Вигодянської сільради очолює Валентина Грабовська, уповноваженою з питань закупівель є Оксана Скєрлік. Головою Вигодянської громади є Алла Рибачок. Вона має понад 35 років безперервного досвіду роботи в системі місцевого самоврядування, пройшовши шлях від діловода до керівника громади.

Кримінальні провадження підрядника

Одеська «Давмір Строй» належить Андрію Межевому із окупованого Сєвєродонецька на Луганщині.

З 2019 року фірма отримала державних замовлень на 238,34 млн грн, найбільше від нинішнього замовника.

У липні 2023 року поліція відкрила кримінальне провадження щодо можливого зловживання службовим становищем посадовцями Управління освіти, культури, молоді, спорту та туризму Нерубайської сільради, а також фірмами «Давмір Строй» і ТОВ «БК Делюкс Девелопмент». Ідеться про можливу розтрату й привласнення бюджетних коштів в умовах воєнного стану. «Давмір Строй» тоді отримала підряд на ремонт гімназії за 3,98 млн грн, а «БК Делюкс Девелопмент» – на ремонт укриття академічного ліцею №1 на 4,84 млн грн і 2,84 млн грн.

У вересні того ж року слідчі одеської поліції відкрили кримінальне провадження щодо ремонту даху «Одеського обласного центру соціально значущих хвороб» на Ядовій,4а. Його замовили «Давмір Строю» за 5,8 млн грн. Поліція підозрювала можливе нецільове використання коштів та завищення об’ємів і вартості робіт.

Вже цього року «Давмір Строй» завищив ціни у кошторисах ремонту шкільного харчоблока у селі Усатове.

Неєвропейське обходження з вимогами Євросоюзу

Також відмітимо, що Управління освіти не включило до договору важливі умови, які дозволяють достроково розірвати договір в односторонньому порядку, у разі якщо:

– на виконавця або його кінцевого власника накладено санкції ЄС;

– виконавець або його кінцевий власник потрапив до санкційних списків;

– виконавець або його кінцевий власник зареєструвався в неприйнятній країні;

– виконавець не підтвердив походження товарів і матеріалів або підтвердив їх походження з неприйнятної країни.

ЄС вимагає від України гарантувати, що жодна операція, яка має збіги з санкційними списками ЄС, не фінансується за рахунок європейських коштів – ні прямо, ні через посередників.

Відсутність таких умов у договорі означає, що Управління освіти може опинитися в ситуації, коли не зможе вчасно розірвати договір із санкціонованим підрядником, що порушить вимоги ЄС щодо використання коштів Ukraine Facility.

Хоча при використанні коштів Ukraine Facility замовник повинен дотримуватися особливих правил щодо санкцій Євросоюзу. Згідно з статтями 3 та 5 Рамкової угоди, підрядники та всі пов’язані з ними особи (субпідрядники, кінцеві бенефіціари) не мають права: перебувати в санкційних списках ЄС; мати проти себе будь-які обмежувальні заходи від ЄС; бути зареєстрованими в країнах, які ЄС вважає неприйнятними; постачати товари та матеріали, які походять з неприйнятних країн.

 

In Odessa region, shelters worth 97 million were ordered from Ukraine Facility at greatly inflated prices.

On June 10, following the results of a tender, the Department of Education, Culture, Youth, and Sports of the Vyhoda Village Council (Odesa region) commissioned Davmir Stroy LLC to build a shelter for UAH 97.41 million. This was reported in the Prozorro system. On the day the contract was signed, the deadline for completion of the work was extended from the end of 2025 to March 2026.

In the village of Vyhoda, at 23 Shkilna Street, an underground shelter is to be built for two educational institutions: the Vyshenka kindergarten and the Vyhoda Lyceum. The shelter, with an area of 2,010 square meters, is designed for 711 people: students, pupils, and staff of both institutions.

According to the contract price, the cost of construction work, excluding equipment, furniture, and inventory, is 86.77 million hryvnia, including VAT. This means that each square meter of the shelter costs UAH 43,169 (EUR 910), which is 45% more expensive than the cost of housing construction in the Odesa region set by the Ministry of Development, which is UAH 23,648 per square meter. The project was commissioned by Taur Engineering LLC. A positive expert report on the cost estimate part of the project documentation was issued by Expert Company Osnova LLC.

The contract price is fixed and includes UAH 355,000 for additional expenses due to inflation. The work will be financed by the European Union through the Ukraine Facility program.

The average monthly salary of a full-time worker in job category 3.8 is UAH 18,570. According to the Pension Fund, the average salary for calculating pensions is UAH 19,856, while the average salary for vacancies in the construction industry on the Work.ua portal in Odesa is UAH 25,000.

The prices in the estimate are inflated by one and a half times

In the information on prices for material resources, concrete C20/25 W6 F150 was taken into account at 4,740 UAH/cubic meter (hereinafter, prices are indicated with VAT and without delivery). The Odessa-based company High Rise Construction Holding sells such concrete at UAH 3,350/cubic meter, which is 29% cheaper, and the company Westt sells it at UAH 3,650/cubic meter, which is 23% cheaper. Concrete delivery costs 2,051 UAH/cubic meter. The distance between Odessa and Vyhoda is 42 km. High-Rise Construction Holding offers concrete delivery services for 41-45 km at 360 UAH/cubic meter, which is more than five times cheaper. Photo_map of concrete delivery to Vyhoda, Odessa region

A500C class reinforcement with a diameter of 12-14 mm was ordered at 59,166-59,477 UAH/ton. IronWorld sells it at the same price of 34,160 UAH/ton, which is 42% cheaper, and Bulat-Metal offers it at 33,800 UAH/ton, which is 43% cheaper.

Teknosel and Arfen Ukraine sell it at the same price of 689 UAH/kg, which is 36% cheaper. An unknown 1.5 mm thick PVC membrane was ordered at 594 UAH/sq. m. The Techno online store sells Tetto Rooftop ST 1.5 mm PVC membrane at UAH 367/sq. m, while the Sweetondale seller on the Epicenter platform offers Danopol HS 1.5 mm PVC membrane at UAH 368/sq. m. This is 38% cheaper. An unknown dry modified cement mixture for plastering mineral bases was ordered at 31 UAH/kg. Stroymat Kyiv sells the Master-Strong dry modified construction mixture at 6 UAH/kg, and Epicenter at 7 UAH/kg, which is more than four times cheaper.

The company was awarded the contract without competition, as no other bidders participated in the open tender.

The Education Department of the Vyhoda Village Council is headed by Valentina Grabovska, and Oksana Skierlik is the procurement officer. Alla Rybachok is the head of the Vyhoda community. She has over 35 years of continuous experience in local government, having risen from clerk to community leader.

Criminal proceedings against the contractor

Odessa-based Davmir Stroy is owned by Andriy Mezhiv from occupied Severodonetsk in Luhansk Oblast.

Since 2019, the company has received government orders worth UAH 238.34 million, most of which came from the current customer.

In July 2023, the police opened criminal proceedings into possible abuse of office by officials of the Department of Education, Culture, Youth, Sports, and Tourism of the Nerubaysky Village Council, as well as the companies Davmir Stroy and BK Deluxe Development LLC. The case concerns the possible embezzlement and misappropriation of budget funds under martial law. Davmir Stroy was awarded a contract to repair a gymnasium for UAH 3.98 million, while BK Deluxe Development was awarded contracts to repair the shelter of Academic Lyceum No. 1 for UAH 4.84 million and UAH 2.84 million.

In September of the same year, Odessa police investigators opened a criminal case regarding the repair of the roof of the Odessa Regional Center for Socially Significant Diseases at 4a Yadova Street. It was commissioned by Davmir Stroy for 5.8 million hryvnia. The police suspected possible misuse of funds and overstatement of the volume and cost of work.

This year, Davmir Stroy overestimated the prices in the estimates for the repair of the school canteen in the village of Usatove.

Non-European treatment of EU requirements

It should also be noted that the Department of Education did not include important conditions in the contract that would allow for early termination of the contract unilaterally if:

– EU sanctions were imposed on the contractor or its ultimate owner;

– the contractor or its ultimate owner was included in the sanctions lists;

– the contractor or its ultimate owner is registered in an unacceptable country;

– the contractor has not confirmed the origin of goods and materials or has confirmed their origin from an unacceptable country.

The EU requires Ukraine to ensure that no transaction that matches the EU sanctions lists is financed by European funds, either directly or through intermediaries.

The absence of such conditions in the contract means that the Department of Education may find itself in a situation where it is unable to terminate the contract with a sanctioned contractor in a timely manner, which would violate EU requirements for the use of Ukraine Facility funds.

Although when using Ukraine Facility funds, the customer must comply with special rules regarding EU sanctions. According to Articles 3 and 5 of the Framework Agreement, contractors and all persons associated with them (subcontractors, final beneficiaries) are not allowed to: be on EU sanctions lists; be subject to any restrictive measures imposed by the EU; be registered in countries that the EU considers unacceptable; supply goods and materials originating from unacceptable countries.
